Parentage Established After In Vitro Fertilization/Injunction from Harassment by Spouse/ Voluntary Impoverishment by Spouse

In an opinion released August 15, 2015, the Court of Appeals in Sieglein v. Schmidt held that a child conceived by artificial insemination during the course of the marriage when the husband consented to the procedure created a presumption of the legitimacy of the child and the obligation of both parents to support the child. In addition, in Sigelein the Court issued a permanent injunction prohibiting the husband from coming within 75 feet of the wife because the husband had a protective order issued against him in the District Court and continued to harass the wife at the parties’ church. In addition Court in Sigelein found that the father had voluntarily impoverished himself despite losing his job by not making sincere efforts to seek employment.
